BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000, two sureties, and conditions prescribed under Section 480(3) of the BNSS.

Summary

The petitioner, Sandeep Kumar, was charged under Sections 305 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 for alleged theft from an informant's mill, with the FIR lodged three days after the incident. The prosecution alleged that the petitioner and three co‑accused stole articles and Rs.5,000 in cash, but no material was recovered from the petitioner and his confessional statement was deemed legally infirm. The petitioner contended that he was falsely implicated, the FIR was delayed without justification, and he had been granted bail in several other cases. The court noted the absence of any recovery, the delay in filing the FIR, the lack of legal sanctity of the confessional statement, and the fact that a charge‑sheet had already been filed after a prolonged custody since 26‑10‑2025. Accordingly, the court ordered the petitioner’s release on bail, requiring a bond of Rs.10,000 with two sureties and imposing conditions under Section 480(3) of the BNSS. The bail was granted subject to the petitioner’s presence at all court dates and cancellation of bond upon violation of conditions.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 305 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 considering the delay in FIR, lack of recovery, and the nature of the confessional statement.
