The court grants bail to the petitioner with conditions of personal appearance and a bail bond.

Summary

The petitioner, Rajesh Das, was arrested in connection with a 2016 incident where a group attacked a railway bridge construction site and stole Rs 50,000, leading to charges under multiple sections of the Indian Penal Code, the U.A.P. Act and the C.L.A. Act. The prosecution’s informant, a railway contractor, identified the petitioner in the confessional statement of co‑accused Kamlesh Ram, who had already been granted bail in a similar case. The petitioner has been in judicial custody since 5 December 2025 and claims the FIR was lodged against unknown persons. The State opposed bail, citing five prior criminal cases against the petitioner. After hearing both sides, the court decided to grant bail, imposing conditions of personal appearance at trial and requiring a bail bond of Rs 10,000 with two sureties. The order directs the petitioner to be released on bail subject to these conditions.

Issues considered

  • Whether the petitioner is entitled to bail despite serious charges under the IPC, U.A.P. Act and C.L.A. Act
  • Whether the confessional statement of co‑accused Kamlesh Ram sufficiently implicates the petitioner
  • Whether the petitioner’s prior criminal antecedents justify denial of bail
