Bikku ManjhiversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail is denied.

Summary

The petitioner, Bikku Manjhi, filed an anticipatory bail application fearing arrest in connection with a criminal case (PS‑Mohanpur Case No.94 of 2025) involving offences under the Bharatiya Nyaya Sanhita, 2023, including sections 191(2), 191(3), 190, 329(4), 352, 351(3) and 103(1). The prosecution alleges that the petitioner and others assaulted the victim, resulting in the victim’s death. The High Court examined the nature and gravity of the alleged offences and concluded that the seriousness warranted denial of anticipatory bail. Consequently, the court rejected the anticipatory bail application and directed the petitioner to surrender within four weeks to seek regular bail, failing which the police may arrest him. The order is limited to this application and does not prejudice any later stage of the proceedings.

Issues considered

                                2. The petitioner apprehends arrest in connection with

anticipatory bail to the petitioner in the present case.

                                5. Accordingly, the application for anticipatory bail is

                                   6. The petitioner is directed to surrender in the court
