The court granted regular bail to the petitioner.

Summary

The petitioner, Irshad Ahmad, was arrested in connection with a cyber‑crime case (Case No. 132 of 2025) alleging offences under several sections of the B.N.S. and Sections 66(C) and 66(D) of the Information Technology Act. The prosecution alleged that the petitioner was an associate of Aashuiq Jamaal, who was involved in creating a fake Instagram ID and cheating a complainant of Rs.1,75,000. The petitioner’s counsel argued that the FIR contains no specific allegation against him, that he has no prior criminal record, and that he has been in judicial custody since 18‑08‑2025. The Additional Prosecutor opposed bail, contending the seriousness of the charges. After considering the facts, the court found the allegations against the petitioner to be general and granted him regular bail on a bond of Rs.10,000 with two sureties. The order directs his release pending further trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under the B.N.S. and IT Act.
  • Whether the lack of specific allegations against the petitioner justifies bail.
  • Whether the petitioner’s clean antecedent and period of custody influence the bail decision.
