Patna High Court

Manoj SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, ordering his release upon furnishing the prescribed bail bond and sureties.

Summary

Manoj Singh, aged 56, was arrested in connection with a case filed on 25 October 2025 under Sections 137(2), 140(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, for allegedly forcibly taking his cousin Abhimanyu Choubey during a financial dispute over the purchase of a JCB machine. The petitioner claimed he was falsely implicated, asserting that the co‑accused Bheem Singh had paid Rs. 24 lakh for the JCB which the victim failed to deliver, leading to the confrontation. He further highlighted that co‑accused Bheem Singh and Yogendra Singh had been granted bail by the same court earlier, and that he had clean antecedents and had been in custody since 26 October 2025. The State opposed the bail application, contending the seriousness of the offences. After considering the facts, the court found no compelling reason to deny bail and ordered the petitioner’s release upon furnishing a bail bond of Rs. 10,000 with two sureties of equal amount. The application for bail was therefore allowed.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 137(2), 140(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 given the nature of the alleged offences.
  • Whether the petitioner’s claim of false implication and the prior bail granted to co‑accused affect the bail decision.
