Patna High Court

Mithu Kumar Singh @ Mitu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

Mithu Kumar Singh sought anticipatory bail fearing arrest in a case registered under Sections 137(2), 87, 140(2) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita (BNS) relating to a Ladania police case. The petitioner claimed innocence, asserting that the alleged victim had left home voluntarily and that her statement under Section 183 BNS did not support the FIR. The State opposed the bail, but the court noted the petitioner’s clean antecedent and the lack of corroborative evidence. Consequently, the court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to cooperate with the investigation. The bail was conditioned on compliance with Section 438(2) of the CrPC, Section 482(2) of the BNS, and verification of any concealed criminal antecedent.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether the victim's statement under Section 183 BNS undermines the FIR allegations.
  • Whether the petitioner’s clean antecedent warrants bail.

                       5. The statement of the victim under Section 183 of

the BNSS does not support the allegation levelled against the
