The court granted regular bail to the petitioner.

Summary

The petitioner, Sujeet Kumar Jha, was arrested in connection with a theft of Rs.30,000 allegedly committed by three persons in a Scorpio vehicle, which was later found at his residence. He pleaded innocence, asserting that the incident was a case of road rage and that he was falsely implicated, with no contraband recovered from him and no prior criminal record. The prosecution opposed his bail, citing the seriousness of the offence under Section 309(4) of the Bihar Negotiable Instruments Act. After hearing both sides, the court considered the facts, the petitioner’s custody since 29‑12‑2025, and his lack of antecedents, and decided to grant regular bail. He was ordered to be released on a bail bond of Rs.10,000 with two sureties of equal amount, subject to the satisfaction of the Chief Judicial Magistrate, Darbhanga.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 309(4) of the Bihar Negotiable Instruments Act.
