The Court granted regular bail to the petitioner.

Summary

The petitioner, Angul Kumar, was charged under Sections 126(2), 115(2), 118(1), 109 and 3(5) of the Bihar Penal Code for allegedly assaulting the brother of an informant with a sharp weapon, causing a deep neck laceration and the amputation of the victim's left thumb. The petitioner contended that the thumb injury was inflicted on his own brother, not by him, and highlighted his clean criminal record and that he had been in judicial custody since 10‑06‑2025. The State opposed the bail application, emphasizing the seriousness of the offences. After hearing both sides, the Court found no compelling reason to deny bail and ordered the petitioner to be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount. The bail was to be conditioned upon satisfaction of the learned District and Additional Sessions Judge‑II, Munger.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the grave nature of the alleged offences under the Bihar Penal Code.
  • Whether the petitioner poses a flight risk or threat to the investigation.
  • Whether the alleged injuries and the prosecution's case warrant denial of bail.

Subjects

  • regular bail
  • assault
  • grievous hurt
  • criminal antecedent
  • sureties
  • session trial
