Patna High Court

Ranjana KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to conditions.

Summary

Ranjana Kumari, a school teacher, was implicated in a FIR (Daudpur P.S. Case No.267 of 2025) alleging that she forged a mark‑sheet and, in collusion with recruitment officials, secured a government teaching appointment, constituting offences under Sections 420, 467, 468, 471 and 120(B) of the IPC. She applied for anticipatory bail, asserting her innocence, clean antecedent and that no departmental proceedings had been initiated against her. The State opposed the bail. The Court noted a similar case where Nilam Kumari, facing identical allegations, was granted anticipatory bail, and considered the petitioner’s spotless record. Accordingly, the Court granted anticipatory bail, directing her to furnish a bail bond of Rs.10,000 with two sureties and to cooperate with the investigation, subject to verification of any concealed criminal antecedent under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite allegations of forgery and criminal conspiracy under the IPC.
  • Whether the petitioner’s clean antecedent and the precedent of a similar bail order justify granting anticipatory bail.

3 29-04-2026 Heard learned counsel for the petitioner and learned

                   APP for the State.

                                2. The petitioner apprehends her arrest in connection

with Daudpur P.S. Case No.267 of 2025, registered for the

offence under Sections 420,467,468,471,120(B) of the I.P.C

                                3. Prosecution case in short is that, the informant

alleges that Panchayat teacher Ranjana Kumari acting in

collusion with the then-prevailing recruitment unit and other

unidentified individuals fabricated a mark-sheet; subsequently,

by utilizing this forged document as genuine, she fraudulently

secured employment through a criminal conspiracy to illegally

obtain an appointment. Accordingly, the FIR.

                                4. Learned counsel for the petitioner submits that

petitioner is innocent and has committed no offence and she has

falsely been implicated in this case. Learned counsel appearing

on behalf of the petitioner submits that petitioner is a lady of

clean antecedent and till date no departmental proceeding was

initiated against her. Learned counsel for the petitioner next

submits that one Nilam Kumari similarly situated as the

petitioner has been granted privilege of anticipatory bail vide

order dated 24.02.2026 passed in Cr. Misc. No.10729 of 2026.

                       5. The learned APP opposes the anticipatory bail

          application.

                       6. On the same allegation another FIR was lodged

bearing Rasulpur P.S. Case No.181 of 2025 in which the

accused was one Nilam Kumari. Even Nilam Kumari was

alleged to have obtained job of Government Teacher on the

basis of forged document. Similar allegation has also been

levelled against the petitioner of this case. Nilam Kumari

similarly situated as the petitioner has been granted privilege of

anticipatory bail vide order dated 24.02.2026 passed in Cr.

          Misc. No.10729 of 2026.

                       7. Under these circumstances and also taking into

account the fact that the petitioner is a lady of clean antecedent

and till date no departmental proceeding has been initiated

against her, I am also inclined to grant privilege of anticipatory

          bail to the petitioner.

                                 8. Accordingly, the petitioner above named, in the

event of her arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

anticipatory bail on her furnishing bail-bonds in the sum of

amount each to the satisfaction of the learned Judicial

Magistrate, Ist Class, Saran, Chapra in connection with Daudpur

P.S. Case No.267 of 2025, subject to the conditions laid down

under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita

                    and with following conditions:

                                 (i) the petitioner shall co-operate in the

                    investigation/trial.

(ii) the learned Court would, however, verify the

criminal antecedent of the petitioner and in case it is found that

the petitioner has concealed her criminal antecedent, the Court

below shall take step for cancellation of bail bond of the

petitioner. However, it is expected that the verification process

would be done expeditiously without causing any delay.
