Patna High Court

Sonu Kumar Singh @ Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail as there is no life‑threatening injury and a likelihood of false implication.

Summary

Sonu Kumar Singh was arrested in connection with a case alleging assault with an iron rod, causing fractures to an informant and his father, and an alleged attempt to fire a country‑made gun. The petitioner claimed innocence, alleging that the injuries were not as serious as reported and that the case was a false implication arising from a family dispute, noting his clean antecedent. The State opposed the bail application. The Court considered the absence of life‑threatening injury, the possibility of false implication, and the petitioner’s clean record. Consequently, the Court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties and compliance with conditions under Section 482(2) of the B.N.S.S. and other directions. The petitioner must appear before the trial court as required.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious‑nature offences alleged under the BNS.
  • Whether the alleged injuries constitute a life‑threatening danger justifying denial of bail.
  • Whether the possibility of false implication warrants bail.
