The court granted bail to the petitioner, finding the allegations insufficiently specific to deny release.
Summary
The petitioner, Ranveer Kumar, was implicated in a criminal case (Barahiya P.S. Case No.279/2024) alleging offences including assault, outraging modesty, robbery and illegal possession of arms. The prosecution alleged that the petitioner, along with co‑accused, entered the informant’s house while intoxicated, assaulted family members, tore the informant’s blouse and attempted to outrage her modesty, and stole cash and ornaments. The petitioner pleaded innocence, contending that the only allegation against him was the alleged outrage of modesty and that there was no specific allegation of assault, rendering the charge under Section 109 of the B.N.S.S. inapplicable. The court examined the non‑specific nature of the allegations, the absence of a concrete assault charge against the petitioner, and the doubtful credibility of the prosecution’s case. Consequently, the court ordered the petitioner’s release on bail with a bond of Rs 10,000 and two sureties, subject to conditions under Section 482(2) of the B.N.S.S. and attendance requirements.
Issues considered
- Whether the specific allegations against the petitioner justify denial of bail.
- Whether Section 109 of the B.N.S.S. is applicable in the absence of a distinct assault allegation.
- Whether the general and non‑specific nature of the accusations warrants the grant of bail.
