Patna High Court

Krishna RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond of Rs.10,000 and specified conditions.

Summary

Krishna Ray was arrested on 30 January 2026 in connection with a case involving the recovery of 30 litres of illicit liquor, alleged to violate Sections 30(a), 30(c), 34 and 36 of the Bihar Prohibition and Excise Act. The petitioner contended that the FIR was fabricated, that he had no involvement in the liquor recovery, and that his prior criminal record was being used to implicate him. The State opposed bail, noting two other pending cases against the petitioner, although he was already on bail in those matters. The Court examined the bail petition, the nature of the offences, and the petitioner’s antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed verification of the petitioner’s criminal antecedents without delaying the release.

Issues considered

  • Whether the petitioner is entitled to bail for offences under the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedents and other pending cases justify denial of bail.
  • Whether the allegations in the FIR are false and sufficient to deny bail.
