Holding

The court granted bail where the petitioner had no alleged role in the homicide and a clean antecedent, but denied bail where the petitioner was alleged to be the principal assailant in a fatal stabbing.

Summary

The Patna High Court heard two separate bail applications arising from the same police case (No.126 of 2025) involving offences under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act, 2023. The first petitioner, Chandan Mahto, asserted that he had no role in the killing of the deceased, had a clean record and had been in custody since 12‑Nov‑2025; the court, noting his innocence and clean antecedents, granted regular bail on a bond of Rs.10,000 with two sureties. The second petitioner, Raju Paswan, was alleged by the prosecution to be the assailant who inflicted a fatal stab wound with a sharp‑edged weapon; despite his claim of innocence and clean antecedent, the court considered the gravity of the alleged homicide and dismissed his bail application. The judgments were limited to the bail applications and did not prejudice the merits of the underlying criminal trial.

Issues considered

  • What is the appropriate exercise of discretion in granting regular bail under Sections 103(1) and 3(5) of the B.N.S., 2023?
  • Does the petitioner’s alleged involvement in the homicide preclude the grant of bail?
  • Do the petitioner’s clean antecedent and period of custody favor bail?
