Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.

Summary

Paras Kumar was arrested in connection with a case registered under several sections of the Bharatiya Nyaya Sanhita, 2023, alleging assault causing injuries. The prosecution alleged that he assaulted the victim, while his counsel argued that the injury was minor and he was innocent. The petitioner sought anticipatory bail, contending that the allegations did not warrant detention. The court examined the nature of the offences and the circumstances of the case. Relying on Section 482(2) of the BNSS, the court allowed the anticipatory bail application, imposing a bail bond of Rs.10,000 with two sureties and standard conditions. The order directs that the petitioner be released if arrested within four weeks, subject to the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted in a case involving offences under Sections 115(2), 126(2), 109, 117, 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023
  • Whether the allegations constitute a case where the court can exercise its inherent powers under Section 482(2) of the BNSS to grant bail
  • Whether the nature of the alleged injury and the claim of innocence justify the grant of anticipatory bail
