Patna High Court

Binda Singh @ Binda Awadhiya @ Binda Prasad @ Binda Awadhiya SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Binda Singh, a senior citizen, was arrested in September 2025 for alleged offences under Sections 25(1‑b)‑a and 26 of the Arms Act, with two country‑made pistols and a live cartridge recovered from his possession. He claimed false implication and highlighted that his three prior criminal antecedents, for which he is presently on bail, are unrelated to the current charge. The State opposed his regular bail application. The Court considered the petitioner’s age, lack of similar prior offences, and the circumstances of the case, and ordered that he be released on bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount. The application for bail was therefore allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the Arms Act offences.
  • Whether the petitioner’s prior criminal antecedents and the nature of the seized weapons preclude the grant of bail.
