The court granted bail to the petitioner.

Summary

Ravi Kumar Soni applied for bail in a case involving alleged robbery of Rs 50 lakh, charged under several sections of the Bihar Non‑Compulsory Statutes (BNS) and the Arms Act. The prosecution alleged that unknown miscreants committed the theft, while the petitioner’s counsel argued that CCTV footage identified the petitioner’s brother, not the petitioner, and that a confessional statement exonerated the petitioner, stating he merely stored the looted money. The petitioner has been in judicial custody since 13 January 2026 and has no prior criminal record. The State opposed bail, contending the petitioner was identified in the CCTV footage. Considering the evidence, the court found the petitioner's claim credible and noted that similarly situated co‑accused had been granted bail, and therefore ordered the petitioner to be released on bail upon furnishing a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences charged.
  • Whether the CCTV identification and confessional statement sufficiently exonerate the petitioner.
  • Whether the petitioner poses a risk of absconding or tampering with evidence.
