Holding
The Court held that the extension of time cannot be granted as the anticipatory bail was rejected.
Summary
The petitioner, Shivnandan Mandal, filed a petition seeking modification of an earlier order dated 03-10-2024, which had rejected his petition but permitted him to surrender within four weeks. Over a year and a half later, he applied for an extension of time to surrender. The State, through its learned Additional Public Prosecutor, argued that the anticipatory bail application had been rejected, and therefore no further relief should be granted. The Court examined the submissions and found no merit in extending the time, given the prior rejection of anticipatory bail. Consequently, the Court dismissed the petition for extension of time.
