Patna High Court

Anant Paswan @ Anannt Kumar @ Anat KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Anant Paswan was charged under Sections 103 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for allegedly killing a person. His earlier bail application was rejected in May 2025. He filed a second regular bail application, claiming innocence, lack of prior criminal record, and that three material witnesses had been examined. The State opposed the bail. Considering the length of his custody since August 2024 and the delay in trial, the court allowed the bail, directing a bond of Rs.10,000 with two sureties. The order is limited to the bail matter and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with murder under the Bharatiya Nyaya Sanhita, 2023
  • Whether the delay in trial and period of custody justify granting bail
