The court granted regular bail to the petitioners.

Summary

The petitioners, the mother‑in‑law and father‑in‑law of a deceased woman, were arrested in connection with her murder, alleged to be linked to a dowry dispute. The prosecution alleged that the informant’s daughter was killed after refusing a dowry demand of Rs. 2.5 lakh and a bullet bike, and that the husband of the deceased was already in custody. The petitioners claimed innocence, citing lack of criminal antecedent, the cause of death being asphyxia due to hanging, and that the primary accusation was against the husband. They sought regular bail under sections 80(2) and 3(5) of the BNS. After hearing both sides, the court found no sufficient ground to keep them detained and ordered their release on bail with a bond of Rs.10,000 each.

Issues considered

  • Whether the petitioners are entitled to regular bail under sections 80(2) and 3(5) of the BNS.
  • Whether there is sufficient prima facie evidence linking the petitioners to the murder.
  • Whether the petitioners' lack of criminal antecedent warrants bail.
