Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to a bond and proof of fine payment.

Summary

The petitioners, owners of three vehicles from which illegal stone chips were seized, were named in an FIR under Sections 303(2) and 317(2) of the Bharatiya Nyaya Sanhita, 2023. They applied for anticipatory bail, claiming innocence and that the wrongdoing was committed by the drivers and laborers. The State opposed the bail, while the Mines Department indicated that a substantial fine had been imposed on each petitioner and expressed no objection to bail upon payment of the fine. The Court, considering the facts, granted anticipatory bail to the petitioners, subject to a bail bond of Rs.30,000 each and proof of payment of the respective fines, under Section 2(1)(d) of the B.N.S.S., 2023 and the conditions of Section 482(2). The trial court was directed to accept the bail bonds only upon satisfactory evidence of fine payment.

Issues considered

  • Whether the owners of vehicles used in illegal stone chip transport are entitled to anticipatory bail under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the condition of depositing the imposed fine before granting bail is permissible.
  • Applicability of Sections 303(2) and 317(2) of the B.N.S.S., 2023 to the petitioners.
