Decided
Disposal
DISMISSED

Holding

The court granted permission to withdraw the criminal miscellaneous application, dismissing it as withdrawn without addressing the merits.

Summary

The petitioners filed a criminal miscellaneous application seeking permission to withdraw the application and to raise all points that could have been raised at the time of charge framing, if charges were not yet framed. The State opposed the request. The court considered whether it could grant such permission and allow the petitioners to raise those points later. After hearing counsel, the court granted the petitioners' request, permitting the withdrawal of the application. Consequently, the criminal miscellaneous application was dismissed as withdrawn, with the court expressly stating that it made no determination on the merits of the underlying case.
