Patna High Court

Ranjit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail.

Summary

The petitioner, Ranjit Kumar, was charged under several sections of the Bharatiya Nyaya Sanhita for allegedly entering the informant's house, threatening her with a pistol and committing rape on 29‑08‑2025. He sought regular bail, contending that he was falsely implicated, that the victim had previously settled disputes with him, and that a joint compromise petition dated 02‑01‑2026 indicated the informant no longer wished to pursue the case. The informant and the State did not oppose the bail application. The court, noting the lack of opposition, the existence of a compromise, the petitioner's clean record and the circumstances of the case, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties. The application for bail was therefore allowed.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the serious nature of the offences alleged.
  • Whether the existence of a joint compromise petition and the informant's non‑opposition affect the grant of bail.
  • Whether the petitioner’s lack of prior criminal antecedents warrants bail.
