Patna High Court

Jitendra KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail and allowed the application.

Summary

The petitioner, Jitendra Kumar, applied for regular bail in a case registered under multiple sections of the Bharatiya Nyaya Sanhita, 2023, including assault and related offences. The prosecution alleged that on 1 November 2025 the petitioner, along with co‑accused, assaulted an informant and others, causing injuries. The petitioner contended that the specific assault allegations pertained only to the co‑accused and that the charges against him were vague and general. The State opposed the bail, but the court, after considering the facts and the nature of the allegations, ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties. The application for bail was therefore allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail under the Bharatiya Nyaya Sanhita, 2023 for the offences alleged
  • Whether the general and omnibus nature of the allegations against the petitioner justifies bail
