The application for regular bail was allowed.
Summary
Ravi Kumar Yadav was arrested in connection with a theft case (Raxaul P.S. Case No. 526 of 2025) for allegedly purchasing a stolen motorcycle and was charged under Sections 317(2), 317(4), 317(5), 111(2)(b) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner, who had been in custody since 11‑12‑2025, applied for regular bail, contending his innocence and pointing out that a co‑accused had already been granted bail. The State opposed the bail application. After hearing both sides, the Court allowed the bail, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties, attend the Palanwa Police Station every Sunday, and ensure one bailor is a close blood relative. The bail was granted subject to these conditions.
Issues considered
- Whether the petitioner is entitled to regular bail despite the serious charges under the Bharatiya Nyaya Sanhita, 2023.
