BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to specified conditions.

Summary

The petitioner, Pappu Kumar, was arrested in connection with a case registered under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023, alleged to involve a stolen truck. He applied for regular bail, claiming innocence, and had been in custody since 8 April 2025. The State opposed the bail application. The High Court, after considering the facts and circumstances, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of equal amount and to comply with specific conditions regarding police station attendance and trial cooperation. The bail was granted subject to cancellation if the conditions are breached.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the circumstances of the case justify the grant of bail despite the seriousness of the alleged offence.
