The Court granted anticipatory bail to Amit Kumar, subject to specified bail bond, sureties and maintenance conditions.

Summary

The petitioner, Amit Kumar, sought anticipatory bail fearing arrest in a dowry‑related case (Biraul P.S. Case No. 68 of 2024) involving offences under Sections 498A, 494, 384, 420 of the IPC and Section 3 of the Dowry Prohibition Act. He contended that the FIR contained no specific allegation against him and that he was falsely implicated. The State and the informant opposed the bail. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar (2014) 8 SCC 273, the Court granted anticipatory bail, imposing a bail bond of Rs 10,000 with two sureties and ordering the petitioner to pay a monthly maintenance of Rs 8,000 to the complainant, subject to any family‑court maintenance order. The order also warned that non‑compliance could lead to cancellation of bail. The order was communicated to the District & Sessions Judge for implementation.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the alleged dowry‑related offences.
  • Whether the conditions imposed, including a maintenance direction, are lawful and appropriate.
  • Application of the principles laid down in Arnesh Kumar v. State of Bihar regarding unnecessary arrests.
