Holding

Bail was denied to the petitioner.

Summary

The petitioner, Dinesh Yadav, was arrested in connection with a kidnapping and extortion case (PS Case No. 462 of 2025) and has been in custody since 14 October 2025. The prosecution alleges that he, along with co‑accused, abducted the victim and demanded money, charging him under Sections 140(2) and 3(5) of the BNS. The victim’s statements recorded under Sections 183 and 180 of the BNSS were produced before the court and were found to support the prosecution’s case. The petitioner applied for bail, arguing that he should be released pending trial. After hearing the parties and the SHO, the court concluded that the evidence warranted continued detention and therefore refused bail. The bail application was dismissed.

Issues considered
