Holding
The court held that bail could not be granted in the present circumstances.
Summary
The petitioner, MD Sanjim Ansari, was arrested in connection with a case registered under the NDPS Act for alleged possession of 10.44 grams of brown sugar. He has been in custody since 31 October 2025 and filed an application for regular bail. The court considered the quantum of the seized narcotic and the seriousness of the offences under sections 8(c), 21(b) and 22 of the NDPS Act. The judge was not persuaded that the small quantity warranted bail and therefore rejected the bail application. The court indicated that the petitioner could reapply for bail if the trial is unduly delayed.
