Decided
Disposal
DISMISSED

Holding

Bail was denied as the court found the allegations sufficiently serious to justify continued detention.

Summary

The petitioner, Ankit Kumar, was arrested in connection with a case registered under Section 64 of the BNS and Section 4 of the Protection of Children from Sexual Offences (POCSO) Act for allegedly sexually assaulting a nine‑year‑old girl. He has been in judicial custody since 12 December 2025. The petitioner applied for bail, contending that he was entitled to liberty pending trial. The prosecution opposed the bail, emphasizing the gravity of the alleged sexual assault of a minor. The Court, after hearing counsel for both sides, held that the seriousness of the allegations warranted continued detention. Consequently, the bail application was dismissed, and the petitioner remains in custody.
