BAIL GRANTED

Holding

The court granted regular bail to the petitioner with conditions.

Summary

The petitioner, Bhola Kumar, was arrested in connection with Begusarai Town Police Station Case No. 525/2024 for alleged firing at a victim, charged under Sections 109(1), 118(1), 3(5) of the B.N.S. and Section 27 of the Arms Act. The petitioner claimed innocence, stating that the informant – the victim's wife – testified that he was not the assailant, and he offered to cooperate with the trial. The prosecution opposed regular bail, highlighting the petitioner’s three prior criminal antecedents and his custody since 5 December 2025. The court, after considering the facts and circumstances, granted regular bail on a bond of Rs. 10,000 with two sureties, subject to the condition that the petitioner appear at Muffasil Police Station on any two Sundays each month. Failure to comply would result in cancellation of the bail bond.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the seriousness of the offences under the B.N.S. and Arms Act and his prior criminal antecedents.
