DISMISSED

Holding

The bail application was dismissed, and the petitioner was ordered to remain in custody.

Summary

Vikash Kumar Neeraj was arrested in connection with a cyber‑crimes case (Saran Cyber P.S. Case No. 363/2025) alleging theft of personal photographs, hacking of an e‑mail, coercion into an illicit relationship, recording obscene videos, creation of fake social‑media accounts, distribution of obscene content and blackmail. The petitioner sought regular bail, claiming false implication, no prior criminal record and willingness to cooperate, while the State opposed bail citing the seriousness of the offences and the alleged forwarding of private photographs. The court examined the gravity of the alleged offences under the B.N.S. and the Information Technology Act and found the allegations serious enough to warrant continued custody. Consequently, the court declined to grant bail. The bail application was dismissed.

Issues considered

  • Whether bail should be granted to the petitioner given the seriousness of the alleged cyber‑crimes and offences under the B.N.S. and IT Act
  • Whether the petitioner poses a risk of tampering with evidence or influencing witnesses
