Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

Munna Kumar Kushwaha, a driver, was arrested on 13 August 2025 in connection with a case alleging that a vehicle was released using forged documents, invoking multiple sections of the Bihar Non‑Statutory (BNS) provisions, the MMDR Act and Bihar Minerals Rules. The petitioner contended that he was falsely implicated and that the vehicle owners had already paid a fine of Rs. 4,70,000 and obtained bail in a related matter. The prosecution sought to keep him in custody. The High Court examined the fact that the entire fine had been deposited and that the owners had been granted bail earlier. Considering these circumstances, the Court allowed the bail application. The petitioner was ordered to be released on a bail bond of Rs. 10,000 with two sureties of the same amount.
