Patna High Court

Syed Khalid @ Khalid AnjumversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner with specified conditions.

Summary

The petitioner, Syed Khalid, was arrested in connection with a shooting incident in a court campus and charged under several sections of the Bihar Narcotic Substances Act, 2023 and the Arms Act. He had been in custody since 11 December 2025. His counsel argued that he was not named in the FIR and was only implicated after four months, creating reasonable doubt about his involvement. The State and the informant opposed bail. The High Court, after hearing both sides, granted bail on a Rs.10,000 bond with two sureties and imposed conditions of regular police station attendance and cooperation with the trial. The order was limited to the bail application and did not prejudice the merits of the case.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged.
  • Whether the delay in naming the petitioner in the FIR creates sufficient doubt to warrant bail.
  • Whether the conditions imposed for bail are appropriate and lawful.
