Patna High Court

Dr. Shashi Shekhar Singh @ Shashi ShekharversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the allegations were general and omnibus, and therefore granted bail to the petitioner.

Summary

Dr. Shashi Shekhar Singh was named in a complaint (No. 2367 of 2023) alleging offences under IPC sections 323 and 498A, claiming cruelty for non‑payment of dowry demands. The petitioner argued that the complaint was false, arising from domestic differences, and sought bail. The wife opposed bail, contending she had no income and the petitioner forced her out of the matrimonial home. The High Court observed that the allegations of cruelty and physical assault were vague and omnibus, and therefore not sufficient to deny bail. Consequently, the court granted bail on a bond of Rs.10,000 with two sureties, invoking the inherent powers of the court under Section 482(2) of the CrPC, and directed the parties to seek amicable settlement in the trial court.

Issues considered

  • Whether the allegations of cruelty and physical assault under IPC 323 and 498A justify denial of bail.
  • Whether the petitioner is entitled to bail under the inherent powers of the High Court under Section 482(2) of the CrPC.
