Holding

Bail was granted to the petitioner.

Summary

The petitioner, Lalu Kumar, was arrested in connection with a case registered under Giriyak Police Station (Case No. 596 of 2025) for alleged offences under Sections 115(2), 114(4), 140(3) and 3(5) of the BNS, involving kidnapping and cheating. The prosecution alleged that the victim, Sodi Singh, was abducted after he allegedly cheated Sonu Kumar of over Rs. 10 lakh, and the accused were said to be seeking repayment. The petitioner had been in custody since 31‑12‑2025 and filed a bail application. The victim’s statement that he himself was involved in cheating was highlighted by the court. Considering the victim’s admission and the nature of the allegations, the court found no compelling reason to deny bail. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 10,000 with two sureties.
