Patna High Court

Amrit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to a bail bond and conditions.

Summary

The petitioner, Amrit Kumar, was implicated in a case (Akbarnagar P.S. Case No. 03 of 2026) under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged involvement in the recovery of 94.186 litres of illicit liquor. The petitioner claimed innocence, stating that no liquor was recovered from his possession and that he has a clean criminal record. The State opposed his request for anticipatory bail. The High Court, after hearing both sides, granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs 30,000 under Section 2(1)(d) of the BNSS, 2023, subject to conditions under Section 482(2) of the same Act. The Court also directed the Trial Court to verify the petitioner’s criminal antecedent and to cancel the bail bond if any concealment is discovered.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner satisfies the criteria for anticipatory bail despite the recovery of illicit liquor.
  • What conditions should be imposed on the anticipatory bail under the BNSS, 2023.
