BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a Rs.30,000 bail bond and compliance with Section 482(2) of the BNSS, 2023.

Summary

The petitioner, Afroz Alam, feared arrest in a case involving 1.25 litres of illicit liquor seized under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He claimed innocence, stating that nothing was recovered from his possession, he was not named in the FIR, and he has a clean criminal record. The State opposed his request for anticipatory bail. The Court considered the facts and, applying the provisions of the Bihar Narcotic and Smuggling (BNSS) Act, 2023, granted anticipatory bail on the condition of furnishing a Rs.30,000 bail bond and compliance with Section 482(2) of the BNSS Act. The Court also directed the trial court to verify the petitioner’s criminal antecedent and cancel the bail if any concealment is discovered, but ordered that the bail bond should not be delayed pending verification.
