Holding

The court held that regular bail could not be granted as the allegations were grave and supported by the post‑mortem report.

Summary

The petitioner, Pravin Kumar Sahi, applied for regular bail in a case registered under multiple sections of the Bharatiya Nyaya Sanhita, 2023, alleging he was the assailant of the deceased. The prosecution argued that the allegations were serious and grave, supported by a post‑mortem report. The petitioner claimed innocence, no prior criminal record, and had been in custody since 16‑01‑2026. The court examined the submissions and the material evidence, finding the allegations credible and the offences grave. Consequently, the court declined to grant regular bail, rejecting the petitioner's application.

Issues considered

  • Whether regular bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023, given the seriousness of the offences alleged.

                                2. The petitioner seeks regular bail in connection with

Siswan P.S. Case No. 309 of 2025 registered for the offence

                   under Sections 126(2), 115(2), 118(1), 117(2), 109(1), 303(2),

352, 351(2), 103(1) and Section 3(5) of the Bharatiya Nyaya

                   Sanhita, 2023.

                                3. As per the prosecution case, the petitioner is the

                   assailant of the deceased.

                                4. The learned counsel for the petitioner submits that

opposes the bail application and submits that the allegations

against the petitioner are serious and grave in nature.

                                   6. Having considered the submissions of the parties

and upon perusal of the materials available on record, this Court

finds that the allegations against the petitioner are grave in

                      case.

                      for regular bail stands rejected.
