DISMISSED

Holding

The application for quashing the FIR is dismissed; the Court will not interfere with the investigation.

Summary

Petitioner Radha Kumari Patel, an ex‑Mukhiya, filed an application under Section 482 of the Criminal Procedure Code seeking to quash FIR No. 15 of 2024, which alleged offences including assault, attempt to murder and offences under the SC/ST (Prevention of Atrocities) Act. The prosecution alleged that on 8 January 2024, officials removing an encroachment were attacked and injured, with caste‑based abuse. The petitioner contended that the FIR was filed out of vengeance, that no injury report existed to support the alleged Section 307 charge, and that no SC/ST person was present. The State opposed the quash petition, emphasizing the seriousness of the allegations and the ongoing investigation. The Court, after reviewing the record, held that the matter was at a nascent investigative stage and declined to interfere with the FIR, dismissing the petition.

Issues considered

  • Whether the High Court can quash the FIR under its inherent powers under Section 482 of the Cr.P.C. given the allegations of assault and offences under the SC/ST Act.
  • Whether the lack of an injury report and the petitioner's claim of vendetta justify dismissal of the FIR at this stage.
