Patna High Court

SANJEEV KUMAR MANDAL @ SANJEEV KUMARversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petitioners’ application for regular bail.

Summary

The petitioners, Sanjeev Kumar Mandal and Rajesh Kumar Mandal, were charged with a slew of offences under the Indian Penal Code and Section 27 of the Arms Act, alleged to have assaulted the father of an informant with firearms causing six injuries. The petitioners contended that they were falsely implicated, that the firearm injury was caused by another accused, Hariom Mandal, and that they had been in custody since December 2025. They also pointed to a prior order granting bail to similarly situated co‑accused in Cr. Misc. No. 19788 of 2026. The State opposed the bail on the ground of the seriousness of the charges. After considering the length of custody, the nature of the allegations and the precedent, the Court allowed the regular bail application, imposing a cash bond of Rs 10,000 with two sureties and attendance conditions at the police station.

Issues considered

  • Whether regular bail should be granted to the accused despite the gravity of the offences listed under the IPC and Arms Act.

                                       ORAL ORDER

2 01-05-2026 Heard the learned counsel for the petitioners and the

                   learned APP for the State.

                                2. The petitioners seek regular bail in the present case

registered for the offences under Sections 147, 148, 149, 341,

                   323, 324, 326, 307, 385, 120(B), 379, 504, 506 of the Indian

Penal Code and Section 27 of the Arms Act.

                                3. As per the prosecution case, all the accused persons

called the father of the informant and assaulted him with

firearms and other means. Six injuries have been found on the

                   body of the victim.

                                4. Learned counsel for the petitioners submits that the

petitioners are innocent and have been falsely implicated in the

present case. It is further submitted that petitioner no. 1 is in

custody since 16.12.2025 and petitioner no. 2 is in custody since

03.12.2025. It is also submitted that the firearm injury has been

specifically attributed to one Hariom Mandal, whereas these

petitioners are alleged to have caused injuries to the victim by

means of farsa and bhala. It is further contended that similarly

situated co-accused persons have already been granted bail by

this Court vide order passed in Cr. Misc. No. 19788 of 2026

          dated 29.04.2026.

                       5. Learned A.P.P. for the State has vehemently

          opposed the prayer for bail.

                       6. Having regard to the facts and circumstances of the

case, the period of custody of the petitioners, the nature of

allegation, and the fact that similarly situated co-accused

persons have already been granted bail by this Court, this Court

is inclined to enlarge the petitioners on bail. Accordingly, this

application for regular bail is allowed.

                       7. Let the petitioners, above named, be released on

bail after framing of charge, if not already framed, on

furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand)

each with two sureties of the like amount each to the satisfaction

                                   8. It is made clear that any observation made herein is
