Bullet Singh @ Bullet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a Rs.30,000 bail bond and conditions under the BNSS, 2023.

Summary

The petitioner, Bullet Singh, was implicated in a case (PS Case No. 448 of 2025) for alleged possession of 52.545 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He claimed innocence, stating no liquor was recovered from him and that he has a clean criminal record. The State opposed his bail application. The High Court, considering the facts, granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.30,000 under Section 2(1)(d) of the BNSS, 2023, subject to conditions of Section 482(2) of the same Act. The Court also directed the trial court to verify his antecedents and cancel bail if any concealment is found, but not to delay acceptance of the bond.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the BNSS, 2023 in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s alleged involvement in the illicit liquor recovery warrants denial of bail.
