Patna High Court

Sanoj @ Lala @ Sanoj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to a bail bond and verification of criminal antecedent.

Summary

The petitioner, Sanoj Kumar, was apprehended in connection with a case of illicit liquor recovery under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The prosecution alleged recovery of 35 litres of illicit liquor, while the petitioner claimed innocence and no possession of the liquor. The State opposed the petitioner's request for anticipatory bail. The Court considered the petitioner's clean criminal antecedent and the need to prevent undue delay in bail proceedings. It granted anticipatory bail for a period of four weeks, subject to a bail bond of Rs.30,000 and conditions under Section 482(2) of the BNSS, 2023, directing the trial court to verify the antecedent and cancel bail if concealment is found.
