The Court granted regular bail to the petitioner subject to a bond and conditions.

Summary

The petitioner, Venkat Singh, was charged under multiple sections of the Bihar Penal Code (including offences of assault, robbery and attempt to cause death) and Section 27 of the Arms Act for allegedly entering an informant’s house, firing at him and stealing Rs.1500. The petitioner claimed innocence, asserted a counter‑version of events, and argued that no injury was caused, while also noting that he had sixteen prior criminal cases which had led the trial court to deny bail. The State opposed the bail application, contending that the seriousness of the charges and the petitioner’s antecedents warranted continued custody. After hearing both sides, the High Court considered the lack of proven injury, the petitioner’s willingness to cooperate, and the need to ensure his presence at trial. The Court concluded that regular bail could be granted subject to a bond of Rs.10,000, two sureties, and conditions of attendance and cooperation. Consequently, the petitioner was released on bail with the stipulated conditions.

Issues considered

  • Whether the petitioner is entitled to regular bail despite serious charges under the Bihar Penal Code and the Arms Act.
  • Whether the petitioner’s prior criminal antecedent of sixteen cases justifies denial of bail.
  • Whether the conditions imposed by the Court are appropriate to ensure the petitioner’s presence at trial.
