The Court granted regular bail to the petitioner.

Summary

Rambabu Singh was arrested in connection with a violent incident alleged to involve assault with a garasa, resulting in injuries to Nawal Singh. He faced charges under Sections 191(2), 190, 126(2), 115(2), 329(3), 118(1), 109, 303(2) and 352 of the B.N.S. The petitioner claimed innocence, arguing that the injury report did not match the alleged weapon and that he had no prior criminal record, having been in custody since 13‑01‑2026. The State and the informant opposed bail, alleging concealment of antecedents and serious assault. After hearing both sides, the Court considered the lack of antecedents, the medical evidence, and the nature of the offences, and decided to grant regular bail on a bond of Rs.10,000 with two sureties. The order directs the petitioner to appear before the Additional Chief Judicial Magistrate‑XI‑cum‑Sub‑Judge‑XII, Vaishali.

Issues considered

  • Whether regular bail should be granted to the petitioner despite multiple serious charges under the B.N.S.
  • Whether the injury report undermines the prosecution's allegation of assault with a garasa
  • Whether the petitioner’s lack of prior criminal record warrants bail
