Patna High Court

Amit Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner subject to a bail bond, sureties and conditions of attendance and cooperation.

Summary

The petitioner, Amit Kumar Singh, was charged in Buxar (I) P.S. Case No. 14 of 2019 with offences under IPC sections 147, 148, 149, 323, 307, 504, 506 and Section 27 of the Arms Act, alleged to have fired on a victim causing injuries. He had been in custody since 27 March 2024 and claimed innocence, arguing that the allegations were vague and omnibus. The State opposed his regular bail application. The Court, after considering the custody period and the nature of the allegations, allowed the bail application, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties of the same amount and to comply with attendance and cooperation conditions. The order expressly stated that the observations were prima facie and not to influence the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the seriousness of the offences alleged under the IPC and the Arms Act.
  • Whether the prosecution’s allegations are sufficiently specific to deny bail.
