Decided

DISMISSED

Holding

The Court declined to grant regular bail to the petitioner.

Summary

The petitioner, Prince Kumar, applied for regular bail in a case (S.Tr. No. 158 of 2025) arising from a kidnapping for ransom under Section 140(2) of the BNS. The prosecution alleged that the victim was abducted by unknown criminals and released after ransom was paid, and the petitioner’s name appeared in a self‑incriminatory statement of a co‑accused, Pappu Patel. The petitioner has been in custody since 12‑Nov‑2024. The Court examined the seriousness of the allegation and the presence of the petitioner’s name in the co‑accused’s statement. Considering these factors, the Court was not inclined to grant bail. Consequently, the bail application was dismissed, with the Court noting that its observations are limited to this bail application and do not prejudice the trial’s merits.

Issues considered

  • Whether regular bail should be granted to the petitioner under Section 140(2) of the BNS given the nature of the kidnapping‑for‑ransom allegation and the inclusion of his name in a co‑accused’s statement.
