Patna High Court

Mukesh MahtoversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted, subject to a bond and specified conditions.

Summary

Mukesh Mahto was arrested on 24 January 2026 in connection with a case involving the seizure of 60 litres of country-made liquor, alleged to be a violation of Section 30(a) of the Bihar Prohibition & Excise Act, 2016. The petitioner contended that he was falsely implicated, asserting that the only basis for his arrest was a disclosure by a local chaukidar/villager and that no material was recovered from his possession. The State opposed bail, noting that the petitioner had another similar case pending. The court examined the sufficiency of the villager's disclosure and the seriousness of the offence, and concluded that bail could be granted with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was issued without delay for verification, allowing the petitioner to be released pending trial.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition & Excise Act, 2016 given the nature of the offence.
  • Whether the disclosure by a local chaukidar/villager constitutes sufficient material to justify continued detention.
  • Whether the existence of a prior similar case against the petitioner precludes bail.
