BAIL GRANTED

Holding

The court granted provisional anticipatory bail to the petitioner, subject to the condition that the entire defalcated amount be paid in installments within one year.

Summary

The petitioners, Pravin Kumar Singh and Brajesh Kumar Singh, feared arrest in a case involving alleged defalcation of paddy worth Rs 24 lakhs under sections 103(2) and 61(2) of the BNS. They offered to repay the amount and were directed to pay an initial cheque of Rs 87,000, with the balance of Rs 23,13,000 to be paid in equal installments over one year. The court granted them provisional anticipatory bail for a period of one year, subject to a bail bond of Rs 10,000 with two sureties, in accordance with Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS. The bail bond would be accepted only upon receipt of the first installment, and the petitioners must complete the full payment within the stipulated period, failing which the lower court may pass appropriate orders. The application for anticipatory bail was therefore allowed.

Issues considered

  • Whether anticipatory bail can be granted in a case of alleged defalcation under sections 103(2) and 61(2) of the BNS
  • Whether the court may condition anticipatory bail on the repayment of the defalcated amount
  • Whether Section 438(2) of the CrPC and Section 482 of the BNSS empower the court to impose such payment conditions
