The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

The petitioner, Arun Kumar, filed an anticipatory bail application fearing arrest in a case (Sahebganj P.S. Case No. 457 of 2025) under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 255.620 litres of illicit liquor recovered from a vehicle. The prosecution’s case rests mainly on the confessional statement of co‑accused Nand Kishore Sah, while the petitioner claims he had no ownership, possession, or criminal antecedent and was implicated only through that statement. The State opposed the bail, arguing the seriousness of the offence. The High Court, after hearing both sides, granted anticipatory bail, directing the petitioner to surrender within four weeks and to furnish a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S. The order also referenced a similar bail grant to a co‑accused in Cr. Misc. No. 75974 of 2025.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the confessional statement of a co‑accused alone suffices to justify denial of bail.
  • Whether the conditions prescribed under Section 482(2) of the B.N.S.S. are applicable.
