Patna High Court

Gulam Ahmad Raza @ Ahmad Raza @ PulsarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted and dismissed the application.

Summary

Gulam Ahmad Raza was charged under Section 394 of the Indian Penal Code and Section 27 of the Arms Act for allegedly snatching Rs. 12 lakh from an informant. He applied for regular bail, claiming false implication despite having 17 prior criminal cases and being in custody since March 2024. The prosecution opposed bail, citing the petitioner’s name appearing in the self‑inculpatory statement of a co‑accused. The court considered the seriousness of the offences and the evidentiary material, and concluded that bail was not appropriate. Consequently, the bail application was dismissed.

Issues considered

  • Whether bail should be granted in a case involving robbery under Section 394 IPC and possession of arms under Section 27 of the Arms Act.
  • Whether the presence of the petitioner’s name in a co‑accused’s self‑inculpatory statement and his prior criminal antecedents preclude bail.
